1. Introduction and scope
These Terms of Service ("Terms") govern the provision and use of telecommunications and related digital services provided by ("SkyTel", "Company", "we", "us" or "our").

These Terms apply to business customers, individual customers and other persons using services supplied by .
The Services covered by these Terms include, where offered and applicable:
- Voice over Internet Protocol (VoIP), SIP trunking and wholesale voice services;
- Cloud PBX, hosted telephony and related voice communication services;
- Virtual telephone numbers (DID/DDI), inbound and outbound calling services;
- SMS and related electronic communications services;
- eSIM, mobile data and related connectivity services;
- Associated customer portals, APIs, applications and telecommunications management systems.
The availability and functionality of individual Services may vary according to the customer's location, service configuration, applicable regulations and agreements with network operators and other service providers.
2. Contractual framework
These Terms supplement the Public Offer Agreement for Telecommunication Services of and any applicable individual service agreement, order confirmation, service description, price list and other applicable service-specific conditions.
The Acceptable Use Policy ("AUP") of forms part of the contractual framework governing the use of the Services.
In the event of a conflict between these Terms and an individually negotiated written agreement, the individually negotiated agreement shall prevail to the extent of the conflict, unless otherwise required by applicable law.
Mandatory statutory rights and obligations shall prevail over any conflicting contractual provision.
The use of a particular Service is subject to the terms and conditions applicable to that Service and to the customer's acceptance of the relevant contractual documents.
3. Customer registration and verification
Customers must provide accurate, complete and up-to-date information during registration, service ordering and subsequent verification procedures.
Depending on the customer type, requested Service, jurisdiction, risk assessment and applicable regulatory requirements, SkyTel may request additional information or supporting documentation.
Such information may include personal identification details, company registration information, beneficial ownership information, proof of address, information concerning the intended use of the Services and documentation establishing the customer's right to use particular telephone numbers.
Customers must provide requested information within a reasonable period and notify SkyTel of material changes to information previously supplied.
SkyTel may postpone service activation, restrict access to particular Services or decline an order where required information has not been provided, cannot be verified or indicates a material risk of unlawful or abusive use, subject to applicable law.
SkyTel processes personal data in accordance with its Privacy Policy and applicable data protection legislation.
4. Service activation and availability
Services are activated following completion of the applicable registration, verification, payment and technical provisioning requirements.
Certain Services may require additional approval, geographical eligibility, documentation or configuration before activation.
Service availability may depend on third-party telecommunications networks, internet connectivity, mobile network coverage, numbering resources, equipment compatibility and local regulatory requirements.
SkyTel shall provide Services in accordance with the agreed service description and applicable legal requirements.
Any applicable service activation period, minimum service level, technical limitations or service-specific conditions shall be communicated to the customer as required by law.
5. Customer responsibilities
Customers must use the Services lawfully and in accordance with these Terms, the Acceptable Use Policy, applicable service agreements and relevant telecommunications regulations.
Customers are responsible for:
- Maintaining accurate account and contact information;
- Protecting passwords, SIP credentials, API keys and other account access information;
- Configuring and securing their own telecommunications equipment, applications and networks;
- Ensuring that employees, contractors, representatives and other authorised users comply with the applicable service conditions;
- Monitoring their use of the Services and promptly reporting suspected unauthorised access or misuse;
- Ensuring that communications initiated through their accounts comply with applicable privacy, consumer protection, telecommunications and electronic marketing requirements.
Customers may not use the Services for fraudulent, misleading, abusive or otherwise unlawful purposes.
Where the customer provides telecommunications services to third parties, the customer must ensure that its downstream users comply with the applicable contractual and regulatory requirements.
The customer remains responsible for its own compliance obligations and for the actions of persons authorised to use its account, subject to applicable law and the terms of the relevant agreement.
6. VoIP, SIP trunking and voice communications
VoIP and SIP services must be used in accordance with the applicable service configuration, technical specifications and authorised traffic profile.
Customers must not:
- Generate fraudulent, unlawful or artificially inflated telecommunications traffic;
- Manipulate calling line identification or originating traffic information to conceal the true origin of calls;
- Use telephone numbers without the necessary ownership, assignment or authorisation;
- Initiate unlawful automated calls, robocalls or unsolicited telephone campaigns;
- Route traffic in a manner intended to evade regulatory obligations, carrier restrictions or applicable service conditions.
Customers must ensure that their use of automated dialling systems, call centres and other high-volume calling applications complies with the laws of all relevant jurisdictions.
Applicable technical limits, including concurrent call capacity and calls-per-second limits, may be established for individual accounts or services.
The detailed rules governing the permissible use of voice services are set out in the Acceptable Use Policy.
7. Virtual telephone numbers
Virtual telephone numbers are provided subject to availability, applicable national numbering regulations, documentation requirements and the conditions imposed by the relevant numbering authority or underlying operator.
Customers must provide any information or documentation required for the allocation, activation, continued use or verification of telephone numbers.
Telephone numbers may be used only for lawful purposes and in accordance with the relevant service configuration.
Where a customer presents a telephone number as its outbound Caller ID, the customer must be authorised to use that number and comply with all applicable caller identification requirements.
Unless expressly provided otherwise by applicable law or contract, the allocation of a virtual telephone number does not transfer ownership of the numbering resource to the customer.
Number portability, reassignment, suspension and termination are subject to applicable law, numbering regulations and the relevant service conditions.
8. eSIM and mobile connectivity
eSIM services are provided subject to the technical specifications and geographical coverage of the selected service package.
Customers are responsible for ensuring that their devices support the relevant eSIM technology and are compatible with the selected service.
eSIM profiles and associated activation information must not be copied, transferred, redistributed or used in a manner contrary to the applicable service conditions.
Customers must not use eSIM services for unlawful activities, unauthorised network access, fraudulent traffic generation or other prohibited purposes.
Data allowances, validity periods, supported networks, geographical restrictions and any applicable fair usage conditions are determined by the purchased service package.
Availability and quality of mobile connectivity may depend on the underlying mobile network operator, local coverage, network congestion and device compatibility.
Where emergency calling, voice calling or SMS is not included in an eSIM package, the relevant limitation shall be disclosed in the service description.
9. Charges, billing and payment
Service charges are determined by the applicable price list, service package, individual agreement or order confirmation.
Services may be provided on a prepaid, subscription or other agreed billing basis.
Customers are responsible for paying applicable service charges, including usage-based charges, recurring fees, activation charges and other fees disclosed in the relevant service conditions.
Usage-based voice charges are calculated according to the applicable tariff and billing increment.
Customers may review available billing and usage information through the relevant customer portal or by contacting SkyTel.
Billing disputes must be submitted within the period established by the applicable agreement or mandatory law.
Payment processing, refunds, unused balances and cancellation charges are governed by the applicable contractual conditions, published payment and refund policies and mandatory consumer protection requirements.
10. Service security and prevention of misuse
SkyTel may implement reasonable technical and organisational measures to protect its network, customers, telecommunications partners and other users against fraudulent or abusive activity.
Such measures may include customer verification, access controls, traffic monitoring, technical traffic limits, caller identification validation and investigation of suspected service misuse.
Where there are reasonable grounds to suspect fraud, unauthorised access, unlawful traffic or a material breach of the Acceptable Use Policy, SkyTel may investigate the relevant activity and take proportionate protective measures.
These measures may include requesting additional information, restricting affected routes or services, applying additional technical controls or suspending access where permitted by applicable law and the relevant agreement.
The conditions governing service restriction, notification, restoration and termination shall be applied in accordance with the applicable telecommunications legislation and contractual framework.
SkyTel may cooperate with competent authorities, telecommunications operators and other relevant parties where required or permitted by applicable law.
11. Service limitations and maintenance
SkyTel may perform maintenance, network upgrades and other technical operations necessary for the provision, security and continuity of the Services.
Where required, customers shall be informed of planned maintenance or material service interruptions.
The provision of Services may depend on third-party networks and infrastructure outside SkyTel's direct control.
Any agreed service level, applicable compensation mechanism or remedy for failure to provide the Services shall be governed by the applicable agreement and mandatory law.
12. Suspension and termination
Customers may request termination of Services in accordance with the applicable agreement and statutory rights.
SkyTel may restrict or terminate Services on grounds established by the applicable agreement or law, including material contractual breaches, non-payment, security incidents, fraudulent activity or unlawful use.
Where required by law, SkyTel shall provide the customer with notice, the reasons for the restriction and an opportunity to remedy the relevant circumstances.
Immediate protective action may be taken where authorised by applicable law and necessary to address an urgent security, fraud or network integrity risk.
Financial consequences of fraudulent or unlawful activity
Where a customer engages in fraudulent, unlawful or otherwise prohibited activity, SkyTel reserves the right to apply contractual penalties, claim compensation for damages and recover other amounts payable by the customer in accordance with the applicable Public Offer Agreement, individual service agreement and applicable law.
SkyTel may retain or apply the customer's available prepaid balance towards the settlement of contractual penalties, damages, outstanding charges and other amounts payable by the customer, in accordance with the applicable agreement and law.
Where legally permitted, SkyTel may temporarily withhold a disputed balance where reasonably necessary to investigate suspected fraud, resolve payment disputes or comply with applicable banking, payment processing or regulatory requirements.
Suspension or termination of Services due to fraudulent, unlawful or otherwise prohibited activity does not release the customer from outstanding payment obligations or other contractual liabilities.
The settlement of outstanding charges, treatment of unused prepaid balances, release of telephone numbers and other consequences of termination are governed by the applicable agreement and mandatory law.
13. Personal data and confidentiality
Personal data is processed in accordance with the SkyTel Privacy Policy, the General Data Protection Regulation (GDPR) and other applicable legislation.
SkyTel may process customer identification information, account information, service usage data and telecommunications metadata where necessary for the provision of Services, billing, security, fraud prevention, legal compliance or another lawful purpose.
The processing and disclosure of communications data are subject to applicable confidentiality and data protection requirements.
Customers using the Services to process personal data relating to their own users, employees or communication recipients remain responsible for fulfilling their applicable data protection obligations.
14. Amendments to these Terms
SkyTel may amend these Terms to reflect changes in applicable legislation, regulatory requirements, security standards, service functionality or operational requirements.
Customers shall be notified of changes in accordance with the applicable agreement and mandatory legal requirements.
Where applicable law grants a customer the right to terminate a contract following an amendment, that right shall remain unaffected.
The current version of these Terms shall be made available on the SkyTel website.
15. Governing law and dispute resolution
These Terms are governed by the laws of the Republic of Estonia, without prejudice to any mandatory protections applicable to customers under other relevant legislation.
Customers should initially submit service complaints or contractual disputes to SkyTel through the contact details provided below.
Disputes that cannot be resolved through negotiations may be referred to the competent court or other competent dispute resolution body in accordance with applicable law.
Consumers retain their statutory rights, including the right to seek assistance from the competent consumer protection authority or consumer dispute resolution body where applicable.
